Partition suit

(Querist) 29 June 2013 This query is : Resolved 
In a Partition suit, the plaintiff is withdrawing the suit ( and other claims after getting his share of flat);
Now, I have disputes with the other 2 brothers, but they are not willing to settle my claims.
Could you suggestion what precautions I should take at time of withdrawl, so that I can fight for balance rights, after getting share of flat.
Pls note that I am the only one who has given everything I have earned to these brothers.

It wud depend upon the overall suit as to what property was included in the suit and how the withdrawal is affecting you. So what you should do depends upon many things. Talk with your lawyer.

If the petitioner withdraws his suit and there is no counter claim then you can do nothing in that petition because the petitioner is the master of his case and his will to withdraw his petition cannot be objected by any party to the petition. In that event, you need to file a fresh petition.
