I have sought under RTI ACT for administrative nature corruption related information and in turn I received revengeful attitude and vindictiveness . I am being harassed . kindly suggest me what to do , NS DANGAWAS DIG BSF 07602818933

Honble Shri Shinde Sir,
I, N S Dangawas, DIG(Ops) posted Siliguri (W.B.) inform to your good self that atrocities is on its highest peak by Mr S.K. Sood IG BSF and take this privileged to submit few lines with a hope for sympathetically considerations. I am continuously victimize from last 45 days by Mr S K Sood, IG NBF, in retaliation for simply seeking information’s under RTI ACT, Is it crime to seek information under RTI ACT 2005 passed by Parliament of India . Its is now beyond my tolerance power and I am exhausted due to prolonged continuation of it.
2) I have been denied leave bluntly on 12 occasions in last 60 days without citing any national emergency/valid reasons. Its painful and Inhuman act of Mr. S.K. Sood I.G., I have been informing all correspondences to D.G.B.S.F. New Delhi and Addl D.G. B.S.F.(East) Kolkotta. I have not done any crime or any offences, Where as due to my acute family problems, I had already tendered my Volunteer retirement from service w.e.f. 17th May 2013 & Awaiting from last 60 days. I am young and energetic and I do have dream to become Inspector General or Additional D.G. rank promotions in next 10 years service, Yet to remains but My sensitive family problems after recently two elderly death do not permit me to continue the job.
I have been applying for leave on extreme compassionate grounds as my wife was sick and staying alone since last 03 months as under
1) 17th May 2013 applied for 30 days leave and denied by IG BSF North Bengal .
2) 18th May 2013 requested for 30 days to DG BSF on refusal by IG BSF and no reply received.
3) 17th May 2013 & 20th May 2013 requested Addl .DG.(East) for leave on denied by IG NB FTR and no reply received.
4) 14th June 2013 applied for 02 days leave and denied .
5) 20 th June 2013 applied for 15 days leave and denied.
6) 22nd June 2013 applied for 15 days leave and denied.
7) 25th June 2013 applied for 15 days leave to spl D.G.(East) Kolkotta and denied.
8) 30th June 2013 applied for 05 days leave to spl D.G.(East) Kolkotta and denied.
9) 01st July 2013 applied for 15 days leave and denied by IG BSF NBF.
10) 05th July 2013 applied for 2 days leave and denied by IG BSF NBF.
11) 07th July 2013 applied for 05 days leave and denied by IG BSF NBF
12) 12th July 2013 applied for 05 days leave and denied by IG BSF NBF.
3) Unconstitutional order of withdrawal of charge of office of DIG(OPS) on 20th June 2013 ,Contrary and superseding the orders of D.G.B.S.F. ,Where as I was posted as DIG(OPS). You may issue suitable direction to DG BSF to ‘RESTORE’ status quo in view of High traditions and ethos of elite force, who earned Big name and fame ,While discharging duties either on guarding International Borders or Counter insurgency Operations in J&K ,Assam, Orissa and Chhattisgarh. I am getting an handsome pay and perks say 1,11,000/- per month without any employment. You are requested to restore my charge of DIG (OPS) in order to bring back my dignity & respect , Which was tarnished by Mr. S.K. Sood IG ,Just because ,He is considering me as his potential threat and on exposure of corruption , I am getting enemy like treatment.
4) I am denied of Govt. Accommodation even being vacant house and forced to stay in officer mess from last 70 days and paying rupees 5000/- as rent against 450/-. Its sheer financial denting and vindictiveness’ emerged of Mr. S.K. Sood IG that he can go to any extent to harass me. This matter also brought into kind knowledge of D.G.B.SF. , but No relief received even after 70 days.
5) I have been denied and without intimation in autocratic manner removal of govt. Two civil Telephones lines on 04/07/13 stating I am not performing any Job that too without justification, But to inflicting mental injuries continuously by Mr. S.K. Sood IG. Kindly intervene and save from further Humiliations. Kindly restore telephone lines and allow me to be connected with rest of world till my VRS is accepted by your Honour.
6) As ,I am authorized for Secretarial services of P.A. to DIG rank withdrawn unilaterally on 04/07/13 including Computer(IPP) and Laptop with printer without citing any reasons. Kindly restore my hard earned image and reputation in the eye of Brave Border men. Its pure abuse to DIG rank ,Nothing else.
7) I have not committed any offence or crime except I cannot tolerate any kind of corruption, which in my humble way tried to highlight the corrupt practices of Mr S K Sood, IG through RTI applications. No directions were issued by D.G. BSF on mass corruptions and my human rights were continues to be crushed with vindictive attitude.
8) Mr. S K Sood IG is all out to malign my Image and misleading his superiors by twisting the facts and feeding fabricated stories about me. It is only reason ,He virtually put under arrest, Where as I had requested him not to cause psychosomatic injuries. You are requested to pass suitable instruction to D.G.B.S.F. to remove physical security, I have not committed any grievous nature of crime like Murder or Rape etc. It amounts to infringements into my privacy. I had also intimated DG BSF but no relief received so far.
9) Kindly pardon me for writing to you , as I am left with no other option and redressal of my problems being denied from last 40 days and to get me released from the clutches of Mr S K Sood’ IG. My hard earned Image is being portrayed in bad light by Mr. S.K. Sood I.G. to senior officers, Which I earned unblemished record in last 28 years.
10) I have apprehension that he may try to fix in or entangle me any inquiry to divert from the main issue i.e. nullified my RTI applications. I have been intimating regularly D.G.BS.F. , Spl D.G.B.S.F. New Delhi and Addl D.G. (East) Kolkotta in writing but no relief so far.
11) Its worth mentioning that the sounds of atrocities caused to me is much louder than the malicious act, He is committing harassment an innocent like me with vindictive attitude and experienced by entire B.S.F circle.
12) My mental tension is at its peak and crossing limit of threshold and becoming beyond my tolerance limits. I am writing this letter to you with due regard and keeping fullest faith in you like I have in Almighty. Kindly provide urgent relief please.
13) In this regards, I had requested D.G.BS.F. that Shri Virender Kumar DIG (PSO) /CVO NBF, who is dealing with all these files and he is in full picture of all the corruption cases and gross financial Irregularities and Violations’ of my Human rights done by Mr S K Sood, IG. and he being an honest officer will tell about the ongoing corruption in the Frontier. He confessed me many times glaring financial irregularity with his honest words, if Inquiry is conducted impartially. Kindly intervene and issue necessary instructions in regards to D.G.BS.F.
14) Sir, your immediate intervention is highly requested to save my precious life and my human rights. I may be allowed to lead a peaceful life as my health deteriorating day to day due to unwanted and unwarranted malice unwritten activities by MR. S.K. Sood IG.

Consult a local lawyer with the info as to exactly what kind of information u had sought using rti and what kind of harrassment you are facing. Without this info nobody can guide you. If the kind of info you were exactly seeking is legally obtainable then something can be done otherwise not.

You have taken a legal steps under RTI Act to get information. If you are being harassed, then you may file a petition before the High Court u/s.482 Cr.P.C. for police protection for your safety. You may mention clearly in that petition from whom you are receiving threats.

Seeking information under Section 6 of the RTI Act 2005(if do not fall under prohibited catagory u/s 8 or 9 of the Act)is permitted and shall have to be provided.
However, harassment and vindictiveness cannot be there on this issue, may be some other pretext (can be fabricated). Seek redressal there (let it be BSF, CRPF, ITBP, and/or any other para-military organisation).

You have written to Mr.Shinde that you were victimized for the past 45 days from sending RTI application. But you should have got reply to your RTI within 30 days itself. Did you get reply or not? If not, then you may approach the appellate authority under RTI Act. Instead you have written unnecessarily to the Home Minister. I hope you are taking up the matter in the right perspective and to the right forum, due to which, I am afraid, you are complicating things yourself.

Dear Dangawas,
There is absolutely no crime in asking for any information under RTI, but that all depends upon the tact of asking and language used for information of sensitive or pinching nature.
The application for information has also to be addressed to the appropriate PIO/CPIO, not the higher authorities or the minister.
The application should also not be of the nature of complaint. In fact, you have reproduced a copy of your complaint to the Union Home Minister, not a copy of the RTI application.
Moreover, complaint, if any addressed to any superior authority or the Minister, that has also to be addressed through proper channel, while you can endorse a copy to the concerned authority to be sent in advance, but not the original to be sent directly.
Still further, if your complaint was about violation of human rights, the Union Home Minister was not the appropriate authority to be addressed. Human Rights Commission was required to be addressed on the matter, may that be directly to that authority.
