This query is : Resolved
Does Stridhan includes anchesteral jwellery of Husband's family, jwellery belonging to MIL or SIL etc. Last year my wife forcefully took all above jwellery & kept it in her locker. My mother lodged FIR against her but no action was taken. Now how can we prove in Divorce case that she is in possesion of all above mentioned jwellery including her own jwellery which was gifted by our side to her?

Generally many people will not keep the bills of jewellery purchase. Hence only circumstantial evidence that the jewellery to your family is required.

Stridhan does not include jwellery belonging to MIL or SIL.. However, you will have to prove your contentions in the court. Your mom can file a private complaint in the court if no action is taken by the police.

By 'ishtridhan' it is understood all moveable valuables gifted to girl on occasion and different ceremonials relating marriage by all relatives and friends of either side and the same does not include 'ishtridhan' or jewellery of mother or other in laws.
Your mother should file a separate suit for recovery of value of her jewellery in which
she should also arry bank where the locker is and should pray for injunction against the bank not to allow her to operate during pendency of litigation and when she puts appearance an order of attachment before judgement of her locker should also be prayed for by your mother.
However orders regarding her jewellery would be dealt by Family Court where you can prove her custody in her locker by getting issued a commission to prepare list of ornaments in the locker and then identifying her's jewellery separating your mother's or that of others'.

Kindly tell if any sudden action from Police will be more suitable or I should go for only Court proceedings or both as the Quantum of Jewellery in locker is too much. As before court passes order to Bank for freezing of Locker, she will obviously take everything out of it .
I also have a blank paper signed by her without any date, could it be of any help
for proving my or mother's right on atleast our part of Jewellery .
