we had 40 acres property from my grandfather my father distribute this 40 acres in equal share among two bother,mother and father 10 acres each. Now my father and mother gives their share to my elder brother and also resisted their share to in the name of my elder brother. Can I have any legal option to take some land from father and mother property. My father and mother are live.

NO. It is your father's and mother's property. Therefore they can do whatever that they want to do with the property. Therefore, no one can have any objection if they in their wisdom gives their share to their elder son. You have no legal right to question their action.

Your parents are free to provide that land to any one of their liking as the land exclusively belongs to them after formal partition.
