Terrace water leakage problem

Our flat is located on the top floor of a society in a Mumbai suburb. Just above our flat is a terrace which is privately owned by our neighbour. The problem is that during the monsoons, rainwater seeps through our ceiling in various part of our flat and causes lots of inconvenience. When we approached the society secretary, he said that our neighbour has to do repair work as terrace is privately owned. But, the neighbour says that they will not bear any cost and society has to do the repairs. All this has been in verbal communication. Please provide a solution to this and what can be the action from our end.

none will repair the leakage suffered by lower floor, voluntarily. Your options :-
(i) either you repair at your cost after begging permission of the owner of terrace;
or
(ii) compel them and society to do so by a civil suit.
