Surrogacy in bangladesh

(Querist) 17 September 2013 This query is : Resolved
Dear Experts,

Kindly let me know of the implications on the citizenship of baby born through surrogacy in India to a genetic couple who are nationals of Bangladesh. I would need your advice specially considering that their country (ie. Bangladesh) does not recognize surrogacy or does not have any legislation pertaining to this.

Also please let me know the formalities pertaining to medical visa from Bangladesh for surrogacy treatment in India.

Babies born through surrogacy agreements in India are born stateless. This means they are not given Indian citizenship by virtue of the fact they were born in India.

Each country’s has a different requirements for granting citizenship to babies born through commercial surrogacy in India. All embassies require, at least, a signed copy of the surrogacy contract, baby’s birth certificate, parents’ birth certificates, pregnancy medical records, a signed statement by the surrogate mother and her husband waiving parental rights, and a summary of treatment provided .

if bangladesh does not recognise surrogacy then child born through surrogacy would have problems in getting citizenship of bangladesh
