Father did will before death and gave all propere nothity to his new wife and her children

(Querist) 14 October 2013 This query is : Resolved 
When I was 5 yrs old, my mother died and my father married to some another woman after that. We are two sons from old mother and my new mother has 3 sons. Now before death my father did a WILL in favor of his new wife and her sons. Major portion of the land came to my father from my grand father. And some land my father bought from the income generated from ancestral property only.

Now we 2 sons of old mother has any right on that Property?

Does WILL stand valid in this case?

was it the self acquired property of grandfather or inherited by grandfather from his ancestors .

contact a local lawyer . it is necessary to go through the will made by your father before advising further

Since it was his ancestral property, you have right of share in it.
You have to file a suit for partition for this.

1. For ancestral property, you have share. You can file a suit for partion.
2. For self acquired property, you can challenge the WILL, if you believe it may not be made by your father with clear mind. So, consult a local lawyer

In the ancestral property, you ave share and can claim through a legal suit. Self acquired property can be disposed off as per his wish.
