(Querist) 17 October 2013 This query is : Resolved 
My wife left my home only after one month of marriage on 27 dec 2012. When she left my home she forget her mobile. I heard her last two calls she made on 26th dec. One is with her boyfriend. I made the cd of her conversation but unfortunately that call is now not in her mobile as this is incident of 10 months ago ( calls overridden).

Can I use CD as evidence?

If your CD is an incriminating evidence of her adulterous conduct, you can produce it as evidence and it is admissible as electronic evidence under Indian Evidence Act. Please send it to a Forensic Expert, in order to have clear proof etc.

Yes, you can use the CD s evidence but the same would be admissible in evidence only after its proper test by FSL.
