This query is : Resolved
I had a flat for which I had already done registry in my name. I also taken a loan from bank for which the flat is mortgaged in bank's name and submitted all original docs with bank.
The flat is at Noida (U.P.) and the property is registered in my name.
Around 7 years back I have made an Power of Attorney and only attested through Notary public and I have taken some money from them. This was not registered in Court of Law.
My query is that I need to cancell this Power of Attorney after giving back the amount with interest which I had received from them.
Is it possible as the flat is still in my name and Loan is running in my name.
The person who taken the property from me is staying there.
Shall this Power of Attorney is valid?
Shall I get back this property ?
Please give and advise.

you have mortgaged your flat for repayment of loan and handed over all original documents to bank . in addition you have executed POA in favour of bank .
on your rpayment of loan all original documents including POA will be returned to you . Bank will issue you no dues certifcate

Yes, you can cancel the POA.
The property is yours and there is no question of getting it back when the same is belonging to you only.
