Dear sir,
One complainant of IPC 406,420 on oath admits in cross examination that he gave wrong answer of one question. then Deffence lawyer gave application for notice should be given for cr.p.c 344 against complainant. whether he is liable for punishment?If accused of original case is not convicted then also he is liable for punishment.

as the case may be, false evidence, take cognizance of offence and may, after giving the offender a reasonable opportunity of showing cause why he should not be punished for such offence, try such offender summarily and sentence him to imprisonment fro a term which may be extended to three months, or to five hundred rupees, or with both.
In every such case the Court shall follow, as nearly as may be practicable, the procedure prescribed for summary trials.

340/344 is discretion of court if court find then can be punished, but there are so many chances to defend accused . In my view 344 will not made out.
