I have to file a Chamber Summons in the Citi Civil Court in Mumbai, for changing the address of the Defendant in a Summary Suit. Earlier tried to serve the Writ of Summons through Bailiff but the Defendants have shifted their office. I have the following questions:
1. Since only address has to be changed, can I mention the same in the body of Chamber Summons or I have to annex the address separately.
2. I think first I have to move a precipe and submit to Court and take leave of the Court before Numbering by the office. Is this correct.
3. Can I serve the Writ of Summons duly changed the address alongwith the Chamber Summons on the Defendants at their new address.

As per my knowledge, You may serve the Writ of Summons duly changed the address along with the Chamber Summons on the Defendants at their new address.

You can directly write the new address on the summons form and submit the same before the court. The court will endorse it and will send the same to Nazarat (office of court correspondence). The Nazarat will send the same through their processor (court person who deliver the summons). There is no need of taking permission from the court.
