Transfer of dda flat within family

Dear Sir,

I wanted to know few things-We have a DDA flat at Dilshad garden, Delhi, as DDA new rules if property is leasehold then one has to get converted it into freehold but my question is that my mother and father wanted to transfer their property to their two sons by way of gift deed kindly guide whether it is also required to be freehold first

you would need DDA consent before leasehold interest can be transferred . check terms of allotment made by DDA . advisable to first convert it into freehold .then execute gift deed

Advised to convert it into freehold property before gift.

If DDA allows such transfer before making it freehold then you can do this. So check DDA rules first.

Leasehold gift can also be got executed and registered subject to the NOC of DDA.
