Stamp paper corelation

(Querist) 17 December 2013 This query is : Resolved
Hi! I wanted an advice. My Mom used to run a Knitting mill for over 12 yrs. Whole Property is on my moms name, but registered in mills name. For maintenance, we kept a relative, as an agreement, mom signed an unregistered stamp paper saying he gets 10% profit of the mill. Now, coz of some problem, he stopped taking care of mill, not giving any account details, not returning our cheque book,he still lives with family in mill, taken out money & started new mill..he has been saying people that mill has 50 Lakhs loan..which is not true but still he has cheque signing authority..we worry that he might use these cheques to take more money out of us.
How can we safe guard our property?
If we transfer moms mill to my name, then can he CORELATE 10% share of mill with property since it is registered in mills name?
what steps can be taken?
Can we advertise for loss of cheque book?
which way police can help us?
I also want to know, how worse the scene can be? I want to be prepared..Can police turn against us for cheating because of that agreement???

contact a local lawyer . issue legal notice to relative to furnish audited accounts and to return the cheque books lying with him . request him to vacate the mill premises failing which file suit for eviction .

if he has misappropriated funds file criminal case of cheating criminal breach of trust against him

Immediately notify the bankers to stop payment on the all those cheques if presented on the dates after this notification. Next of course of action can be taken up as per the advise given by the expert above.

In what capacity he is holding the cheque book. Whether your mother nominated him as authorised signatory in the concerned bank. What is his position in the Mill. Whether the Mill is a private ltd.company, partnership firm or proprietorship concern? It appears you do not know full facts and posed the problem here. Take the assistance of some well wishers. If necessary come with full facts so that we can guide you properly.
