Good evening respected members
Due to some dispute the finical institution has refused to receive the EMI from the customer.
hence can i approach the civil court to send notice to the financial institution to accept the EMI ,if so under which provision /order or is there any provision in CPC, that the customer can pay in the EMI to the court.

Hence i request the jury to guide me

Dear Querist Any Finance Institution will not refuse to accept payments in case of defaults since they are capable of adjusting the same towards interest.So better if you could tell me the dispute.

Better you file a suit in the court before the financial institution could take up their process and start remitting the amount in court by producing the evidence of returned Regd posts.Also obtain a stay before the other side could proceed.You have to be very shrewd and fast in safeguarding your client now since the opponents are experts in this.Being a criminal lawyer you should be aware.If necessary take the help of Senior Advocates

Without revealing full facts you are asking for reply. Normally no financial institution will refuse if somebody wishes to pay the EMI. In your case if EMI is refused there must be strong reasons. Please give full details instead of rushing to the court.
