Hi all, i hv to file criminal case against my husband and in laws since he has illegal relationship and i hv all supporting documents to prove it. Im now living in my parents home. Police s not taking fir due to jurisdiction problems. Can i file cases in court and is ths possible to get him ALL punishments as like fir proceedings?

@seetha, If your husband has got any illicit extramarital relationship, it is not an offence as per IPC and on that ground under IPC you cannot file criminal case against him. But such relationship is mental trauma to the legal wedded wife and is mental harassment. She can file domestic violence case against the husband for keeping the extra-marital relationship. This case can be filed directly before the Metropolitan Magistrate/First Class Judicial Magistrate. If he is physically abusing you with the demand of dowry or at the time or after the marriage, he took dowry, you can file S498-A dowry harassment case. For that you have to file complaint in your local police station. If police is not taking proper action, you can directly file private complaint case before the Magistrate for registration of FIR. The Magistrate after taking evidence from you direct the police to register FIR and conduct prosecution against the husband. If you do not want to maintain any further relationship and want divorce, you can file a petition on the ground of adultery.
