Pvt schools in u.p. charging fee on quarterly basis

My ward studies at a CBSE affiliated pvt school run by an education foundation. The school charges fee on quarterly basis in advance at the start of the quarter and charges late fee @ rs.10 per day after 10th day of 1st month of quarter.
As per Delhi High Court order dated 10th April 2013,
"parents cannot be forced to deposit the school fees on a quarterly, half-yearly or yearly basis."
My query is
1. " Can this Delhi HC judgement be enforced on schools operating in Ghaziabad, U.P.???"
2. If not, what is the way out for parents seeking relief on the same grounds as petitioners of similar case filed at Delhi HC on which the above judgement is passed???

Every state is having their own rules on fees structure. This is irrespective of State run or CBSE. So, you may check with the local Educational department for the rules in fees structure.

UP School is not bound to follow Delhi HC order. Quarterly payment is very much a rule/practice in almost every state including WB and it is not considered illegal in these states.

If the Ghaziabad school's management has its head office and operating from Delhi, you can force the school management to comply HC order, otherwise, take the matter in UP High Court and place HC of Delhi order and persuade them to give similar direction just like Delhi HC. Why do not you contact Sh. Ashok Aggarwal, Advocate of Delhi High Court who is working in the name of "social jurist" and trying to bring legal relief in the educational sector?
