I am Lanlord & my tenant has obtained Permit Room & related P P E Licences on Forged NoC in the year 1994. I came to know in 2012, through filling RTI with the Hotel License Branch. Immediately I registered FIR with N.M.Joshi Marg Police Station. After much persuing case. I O registered FIR No.46/12 of 2012 and thereafter, running from pillars to post, filled Criminal Case No. 990/PW/12 dt. 26/11/12 in Bhiowada Court No. 13. Matter is pending & adj. to 27/2/2014. Booked the Accuced u/s 420,465,467,468,471.) The serious matter is that State Excise Dept Mumbai-City & Hotel License Branch both refuse to Cancel Accuced Licences on my Appeal Hearing. The District Magistrat & DCP of License Branch states that after the outcome of the Criminal Case, we shall cancel his Licences, and my appeal has been dispose off. My opptioned was to approach Commissioner of State Excise, but it has already time barred (more then one year past). Can I approach to Hon'ble Lok-Ayukta and Up-LOkayukta of Maharashtra and/or obtained time barred order from Commissioner of State Excise and filled Appeal before the Hon'ble Minister Shri Ramesh Naik.
Can your goodself appoint a Lawyer in this field. I shall be highly oblige for the same.

Unless it is proved in the court that the N.O.C in question is a forged one Licenses cannot be cancelled. So long the dispute is pending in the criminal Court any interference, intervention and even tending to intervene or interfere shall be treated as interference with due course of Justice and that amounts to CONTEMPT OF COURT.

Respected Sir,
I agreed with Ld. Adv. Shri Biswanath Roy, but the question arises that Criminal Court will take 8 to 12 years time, to pass order. Till then Accused enjoy it criminal activities. Criminal Case filled by the Police to Prosecute the Accused for forgery and cheating. with the Government & the Complainant. So whether the Permit Room & P P E L Licenses should be Suspended until then. What the Remedy until then. Accused making jokes of the Complainant.

If the permission is otherwise legal than just because no NOC from landlord is no validity.
And the matter is old so just possible the landlord gave NOC initially and later changed mind to harass the tenant.
Otherwise how it can be believed that for SIXTEEN YEARS the landlord kept quite.
These are all matters which have to be decided by evidence by courts.
There is always other side of legal action .

Respected Sir,
I agree that the matter is of 1994, when the accused become tenant of landlord. Previouly it was Tea & Vada Pav Shop. The accused has entirely change into Permit Room & Ladies Dancing Bar with High Voltage Orchestra, Music & Singing goes upto 4 a.m. That to in the Residential Building Premises. No tenant dare to complaint against the said accused. All with nexus with the concerned authorities. We are in the business field, we are very far away from accused illegal activities. We are Muslim (Bohra), we dont drink and allow any one to drinks, so where is question that landlord gave NOC initially and later changed mind to harass the tanant. I say on oths that on my complaints with the N. M. Joshi Marg Police Station regarding same in the year 2012, one officer guided me and asked to file RTI with the Hotel Licence Branch-I. I do so and entire episode came out and rest is story. Which I have already mentioned in lawyersclubindia.
