we stay in an independent bungalow in hyderabad. the down portion of our bungalow is owned by my dad’s brothers who have sold it and now the new owners are running a full fleged irani hotel under the name of a take away is it possible to take any legal action ? there are cases regarding the partition of the bungalow in the city civil court,hyderabad which prohibited a third party from buying the building…but still they have sold it. this hotel is disrupting the peace of our family. kindly advise

If it is run on valid license then you could nothing.
However you have remedy for your peaceful possession if there is nuisance or disturbance in it.
However that is not enough to stop running the eatery.

or Hotel business NOC from nearby residents is must. Object Police to issue NOC,
Try get STAY , on commercial activity in residential home.
Safety hazard, incoming of unknown person, non hygienic, as no drainage etc, Electric supply need commercial rate/ Local body cannot issue licence w/o owner's consent..
smelling/ hot gas from cooking,
Hotelier must have paid/ managed Police and Local body, So you have to involve Politician etc..

You failed to manage your uncle (father's brother), it would be difficult to manage a stranger who is running a business in the premises. But conditions may worsen if no step taken.

if an injunction was granted restraining sale of ground floor of bungalow and yet your uncle has sold the bungalow take out contempt of court proceedings against your uncle .
apply to municipal corporation for revocation of license of hotel . enclose copy of order passed by court .
