Pil filled aginst industry on grounds of pollution

(Querist) 08 February 2014 This query is : Resolved 
PIL has been filled against a Factory citing air, noise and water pollution as grounds.
Factory was established in year 1988 auctioned by UPFC in year 2004
NOC received from Pollution department by old owner
concent applied but no communication received from Pollution Dept
factory located at SH in Uttar Pradesh approved and classified commercial area
please help

Since You are the present owner include UPFC as party and make them responsible.Also approach the Pollution Dept and find out why they are not responding and you could also seek the reasons for no response thro RTI .Consult your Lawyer.

No need to obtain a fresh Certificate from Pollution Control Board (PCB) as and when the owners are changing. PCB once issued a Certificate to a factory, the certificate is in live, since the closing of factory.If any problem, which ultimately damages to the environments, because of the high increasing of the pollutions from the factory, only your PIL can be maintainable. Otherwise, it does not have any locus standi.

In any PIL atleast one Public Authority should be a party and in this case the court will definitely serve the notice to PCB.Better to sort it out with PCB so that they would also file a favorable Reply in Court.
