Tenants not complying with court cases

(Querist) 09 February 2014 This query is : Resolved
Respected Sir's

The Landlord has filed eviction suits on two of his tenants as they have done illegal additions/alterations in the tenanted property without the NOC from landlord.

All the suits filed are in stage of cross examination of the Landlord (plaintiff ).The Tenants are still doing some renovations or the other on the pretex that they can do the work of repairs, colouring in the property and they do not require the permission from Landlord or the Court. They are NOT maintaining the status-Quo of the property.

In this state what action can be taken by the Landlord. Can he take stay order against the tenants

Please advice.

Thanking you in advance

If status quo not taken already it should be taken immediately. If already taken, gather proof of addition / alteration being done and file contempt case.

it appears that no orders for staus quo has been passed by court . make an application to court that defendants be restrained from carrying out any further alterations in the suit premises

I think even if status quo order is there it would not mean to restrain a tenant from doing whitewashing or correcting electricity fault or leakage in tape water.

However you can always move to court for contempt if injunction is there or for injunction if it is not there.

Apply for appointment commissioner so the court officer can visit the suit property and submit its report.
It is a good ground for eviction.
