Cancellation of agreement to sell immovable property

Dear Sir,

I being the owner of the immovable property executed an agreement to sell the property in favor of Buyer. Now i donot want to sell that property. I am not received the full consideration. The agreement to sell the property is of july and on that date the party has to pay the balance amount. I have accepted the advance. Please suggest whether i can cancell the agreement, giving reason that my family members not agree for this. However i am the absolute owner of the property.

and also Please suggest how can i cancell the agreement to sell the property.

Without seeing the agreement , it is difficult to advise. The agreement can not be cancelled at the sweet will of a party.

So refer to the terms of the agreement.

You cannot cancel the agreement on the reason you cited rather if the buyer has violated the terms of the agreement, only then it can be got cancelled with prior notice to the opposite party.

You have to refer the terms of agreement, If any clause regarding cancellation that may be followed with. If no such clause agree with the advise of expert raj kumar makkad ji.

It is not so easy to cancel the sale agreement once it has been signed by both the parties and the other party is ready to perform his part of the contract. By cancelling the same you will land up in problem, instead wait until the agreement period is over and after that do not act on any of his pressure, let him file a suit and claim the property.
