Dear Experts,
My Mom has purchased a piece of land on 3 of our siblings names (me and 2 brothers), out of which 1 brother has taken a educational loan by mortgaging the property and parallelly rented the property for some considerable amount, Now, May I know, if the other 2 owners (Me and another brother) have any right on the rent earned? If yes, how do we resolve this? Please suggest. I am daughter out of the 3 owners. All the 3 of our names are there in the registered sale deed and we (other 2) have signed a NOC to bank while he was taking the loan, but now things changed.

Whether all the three names are mentioned in sale deed.whether you had signed the Loan agreement to bank.If Not Serve a Legal Notice to Bank And to your brother.Regarding Rent issue a Legal Notice to your brother as well as Tenants.But make sure the Tenant has got chances of taking advantage of this,Try to Sort it out amicably with your brother First and then Proceed
