Daughter in law can claim to in laws for maintenance if husband disapeared

(Querist) 11 March 2014 This query is : Resolved 
Dear Sirs,
Its (Hindu religion) two year passed and a married girl drop by husband to her parents home for first child delivery. Till after that he disappeared from country. Girl don't have any clue where he gone nor any information from in laws. She made several police complaints and also her in laws harassing to enter in laws home. refuse to take in.
So she have one child. Eight months passed. No sign of husband. So in what legal ways she claim for maintenance from inlaws and how ?.

She can file case under PWDV Act for maintenance and for accommodation.
His last known address can be mentioned in the case.

It is only in that property in which the husband has a right, title or interest that the wife can claim . in present case husband has disappeared if her husband had any flat or share in his parents flat she can claim right to stay in matrimonial home .

I agree with Mr. Barman's opinion and suggestion. She can very well file a maintenance case against her father in law by a charge under the husband's property, under such circumstance because that house was supposed to be her matrimonial house and may be her husband has a right or share in it, let her father in law say that his son has no share in the property..
