Company not giving the releaving letter

Hello sir,
I am working in a private company(not Multinational company) . Now I got a job in the other company. According to the Appointment letter , I had give one month notice period , but still the present company not giving the Reliving letter. And the Future company (Where I am going to join) wants the Reliving letter. I joined in the company on OCT 2013 and submit the Resignation letter on Feb 2014. Basing upon this the present company says "He is not giving Reliving letter them who not Works min. of 6 month with him . But this rule is not mentioned in the Appointment letter .
So please suggest What to do on this. I thought it is the right to every employ to have the reliving letter after complication of the notice period on the resignation letter

as per terms and conditions of your appointment letter you have to give one month notice . you have resigned and followed the conditions laid down in appointment letter . in such a case company is bound to give you relieving letter
if company refuses to do issue legal notice to the company
if inspite of legal notice company fails to issue releiving letter you will have to move court to direct company to issue you a relieving letter

If company is not issuing relieving letter, send legal notice for the same.

If you have complied by the company's condition on resignation issue, the company is obliged to issue the relieving letter, contact a lawyer and issue a notice demanding the same.
