Claim of deceased sister insurance policy

My name is Mr. Yogesh and my sister who was holding the 2 policies of LIC policy.As per my knowledge the one policy was nomiated to her husbandand the other policy was nominated in my name. She was expired on 05/09/11 due to her health problems. As i visited the LIC Mumbai branch i got the information that the 1 policy is already claimed and settled in the favour of her husband. I dont have any objection as he was the nominee for the same. But when i claimed the other policy for which i am the nominee they said that I need to get the Succession Certificate for the same. I could not understand when i am the official nominee in LIC records then why i have to go through this procedure. There was some personal reasons/problems between sister and her husband relationship till her death for which she had kept me as a nominee for the second policy even after her marriage. Pls advise what need to be done for the same.

Nomination does not supersede succession.
Nomination is the hand to receive the proceeds and distribute it amongst the legal heir.
Husband is Class1 legal heir.
The legal heir might have raised an objection with LIC.
Otherwise LIC can discharge the claim/proceeds to nominee.
You may submit the claim with death certificate under proper acknowledgment and approach the Div. Manager-CRM, and would be informed of the status.
You may demand reply thru redg. Post only and may mention that postage prepaid self addressed envelope is attached for sending the redg. Post to you.
You may even pursue thru RTI.
If the claim is settled in your favor the legal heir can proceed to recover the claim amount from you.

Your brother in law would have submitted a claim form for this policy too in the capacity of legal heir/successor, since he has already claimed the policy moneys in other policy, the LIC would have put an hold to his subsequent claim because there subsists a valid nomination , however the nominee is a mere trustee who can receive and disburse the policy moneys to the legal heirs/successors of the deceased policy holder, so it is better that you compromise with your brother in law and arrange to settle the claim amicably instead of dragging on the issue for years.

Lodge your claim officially with the LIC. If any objection get the same in writing and Move to the consumer court if claim not settled. If legal heirs have any claim they should settle it from nominee or bring orders of competent court.
