Consent Decree can Challenge........

(Querist) 21 March 2014 This query is : Resolved
We hv family settlement with compromised court decree . In the same commitment was given frommotherinlaw that she will give me 2acre of land but now she is denied.
My question is can we challenge the registered compromise decree.

Yes but not an easy task.
You can file a fresh civil suit to declare the decree null and void if you could prove that the same was obtained by paying fraud on court or that it was was obtained through force or coercion which is not so easy to prove though.

Like any agreement a compromise decree can be also challenged on the ground of fraud or impersonation by a petition in same case as no fresh suit lies now,but a tough case to handle.

Whether the mother in law was a party in the compromised decree.

Agree it would be a tough case to handle.
