Bhogwata 1 & 2 (7/12 extract)

Dear Sirs,
We have a land, the 7/12 of which mentions entry as Bhogwata 2. Somebody has told us that it cann't be sold unless it is transferred to Bogawata 1.
can you please guide me if this is so? If so, how much time, money need to be spent for making the change to Bhogwta 1.
Cann't I sell it to a potential buyer who is ready to buy under Bhogwata 2.
Please guide.

Dear Mr. Amit,
1. Bhogwata - 1 means the land is of old tenure. i.e. the land is of private ownership.
2. Bhogawta-2 menas the land is of new tenure and the property is that of the State yet citizens are allotted such land by the gram panchayat for to sustain their livelihood by the mode of cultivation of the land.
3. If Bhogawat- 2 land is in possession of the original allottee for more than twenty years the the state allows such possessor to pay some premium amount to the state and have such new tenure land converted into old tenure land.
4. Meet the Village Revenue Officer for such information for conversion from Bhogawat-2 to Bhogawat-1.

I too agree with expert Mr. Rohit Sharma's views on the subject. Bhogawat is almost an unregistered oral lease agreement, for which the answer for further dealings in that matter lies with the State government Revenue department, namely Tehsildar/Revenue Divisional officer.
