Adoption

(Querist) 30 May 2014 This query is : Resolved
Dear Experts,

My friend was adopted by his grand father's brother who had no child.
Once his adopted father died he entered his real father's name in Residence & id proof such as DL/Rashion card. Now one property standing in his adopted father's name. How he can claim that. While his adopted parents & real father already died.

How the adoption was made.
If it was done through execution of a deed of adoption or through court order then those proofs are sufficient.
if not then he will have no claim on his adoptive father's property.

By court order
tarun (Querist) 30 May 2014
There was no court order & no adoption ceremony was observed only through mutual understanding he was given in adoption.
He had old rashion card & voter card with his adopted father's name

It would be difficult to prove that he was adopted, if proved he would loose share in the property of his biological father.

Old ration card can be got used for that purpose.
