Bank deposit recover by suit

Dear Sir/Madam,

My mother was died 5 months before. She has deposited Rs.6 Lakh amount in the Canara Bank, Chennai, Tamilnadu and appointed nominee as my father. District Thasildar’s Heirs Certificate is showing my father and my name for her heirs. Can I claim Rs. 3 Lakh in the amount. I kindly ask your reply.

Dear Manaokaran,

1. The bank will release the money to the nominee. But if your provide the legal heir ship certificate to the bank then they will release the money in the joint names of the legal heirs. Then you can settle it with your father.

If your mother has died without any Will then you do have 1/2 share in the money but the Bank would release the whole money in the name of your father only from who you can alter claim half share.

Bank would pay the amount to nominee who is trustee of the legal heirs of the deceased for hat deposit, You being the legal heir, claim your share from the nominee.

If you are apprehensive that your father shall not pay the amount then you can lodge your objection with BM (and if reqd. circle manager, Nodal officer) and BM may obtain affidavit from you/father and pay to both or may ask to obtain order from court.

If bank has paid to nominee then it has discharged it s responsibility.

Bank do not see who is heir but release full amount to nominee. If u put ur claim bank will only hold on the amount. Better settle within yourself.
