Dear Sir/Madam
A person done a will before 15 -16 years ago. now he is dead and the grandson wants to executed it. the daughters are in abroad.but they can agree to given noc. what is the format of noc from a nri. how send the noc, on which country stam paper is used for their affidavi (in case of a nri)the Validity of will under limitation act.

when did grand father die? grand son has to apply for probate of will . you have not mentioned where the property is situated .
daughters have to execute relinquishment deed . have it stamped and regd

Grand father died above 6 years back. The situated in Gurgaon will is not registered. The problem is if grandson probate the will the he will make defendent parties but both the aunties denied to came india. Now what do he do?

If the notice is sent abroad to his daughters and no reply is filed still the will can be upheld.

I agree with expert Sh. Sudhir Kumar, get the court notice served to respondents (aunts) abroad and let them not join proceedings,,it will be decided in favour of beneficiary.

who is the beneficiary in the will? are the people residing n abroad are included as beneficiaries in the will?, if so, they can be impleaded as parties (respondent)and a petition to probate the will may be filed, if they don't receive the summons served on their last known address, a paper publication serving the summons will be enough to get an exparte order.
