Act 138, fraud case

(Querist) 08 December 2014 This query is : Resolved
Dear Sir/Ma'am,

I am Jasneet Singh from Patiala. I just want to consult about my father's case.
One person who is having 10 cheques of the year 2001 had given the cheque to someone to file a false case against my father.
We didn't know the person who used the cheque and filed the false case of Rs. 50000/- against my father.
I went to his shop and asked why he is doing this. He said, "I did this under pressure of my Lawyer because my so many cases are running under my council. I don't know your father and never seen his face before."

I recorded his complete video in HD through my cell phone.
Now we have filed the same Video in Court.
Now he is saying, "this is not authenticated Video. He amended the video because he is master of computer".

Now please suggest me What I have to do.

I have more solid proofs against him. His statements are different in Police investigation and in court notice.

I just want to know, if he proved defaulter, what punishment he will face through court. Can Court give an order for the compensation to him?

Regards

Being 13 years old cheques case, You have a pretty sound case of defence, provided you discuss the issues personally in detail with some expert for having detailed guidance how to proceed further in the case.

if your father is found guilty court may sentence him to imprisonment and direct your father to pay complainant compensation
