Title and khata not transferred to heirs, how to legally go about it

(Querist) 20 February 2015 This query is : Resolved
Dear Sir,
A piece of land was bought by my great grand father in 1917 and wasnt sold until his death which occured in 1930 and currently we have the certified copy of its title deed.
But in Index of Land Record Of Rights for the same property it states that some other person was found to be the Khata holder from 1926.Since we havent sold the property how do we get back the ownership of the property?
NOTE:the property is still vacant

On the basis of the title deed, all the legal heirs gather together, make a partition, release deed, and get them registered and take possession of the property subsequent to which you all may apply for individual katha, this may fetch you some result, take the help of a local lawyer and proceed.

Get the copy of Khata right the date of purchase and show the documents to your lawyer.

Thank You for your replies.
But i still have a bit of doubt.
1)What if they are not ready to register us back our property.how do we go about that?
2)what if we go and speak to them directly
and they are willing for a compromise? how do we deal with this compromise?

There are legal ways to do certain things and all of which cannot be explained everywhere, you consult your lawyer, discuss the issues and proceed, if you find your lawyer not competent enough to give a proper advise, you may look for a expertise lawyer and take his advise on appointment.

If u have sold the property then it should go to third party name. If not, find out from Tahasildar office record n transfer in ur name
