Is mediation agreement binding?

(Querist) 23 February 2015 This query is : Resolved 
Sir,
My wife has filed for divorce.the case is in prl.civil judge (sr div).the case was referred for mediation.the mediation was successful and we agreed for mutual divorce.
the agreement was signed by both of us and our lawyers and the mediator.it will be sent to the court,the hearing date is next week.
i feel that she may backtrack.is the agreement binding or not.kindly provide information on this.

once agreement has been signed by both the parties your wife would need cogent reasons to back track . if she refuses MCD then divorce petition filed by you will proceed on merits

Since you have concealed your identity your wife can be smarter than you and may not agree to the decision taken in mediation before the court, not binding.

It will not be possible for the experts to foresee what is in her mind and what she will do in the future. If she withdraws her consent in the last moment, you may file a regular divorce petition quoting the same as reason.
