Dear Sharmaji,

Pahale yeh jaan na bahut jaruri hai ki ladki ki pitha koi WILL tho nahin lik ke gaye?

Agar WILL nahin hai, tho ladki apna hissa mang sakthi hai. Kisi ko uska huk cheen ne ka adhikar nahin hai.

Pahela, ak legal notice unki mammi aur brother's ko bej na padega. Ek or do mahine ke baad, koi uchit jawab na milne se, court approach kar ke, suit for partition and possession file kar sakthi hai. Yeh bhi dhyan mein rakna hoga, ki ladki ko court fee jama karna hoga (yeh isliye ki abhi unke pass property ka possession nahin hai.)

Ithna prathmik jankari ke baad, apne ilake ke acche vakil se sampark karke mamla ko aage badayein.

The daughter has right for her share in her father's intestate property. You have not mentioned whether the father had executed a Will Bequeathing the property in favor any beneficiary excluding the daughter.Confirm.
During the life time of the daughter, her children have no rights to sue seeking partition and separate possession of their mother's share.
