Law of limitation act 1963

(Querist) 23 January 2016 This query is : Resolved
The bank had sent a notice under SARFAESI act in Nov.2010. The borrower had replied it. Still the bank could not take any action under SARFAESI act as the loan documents including the loan agreement were forged and disputed And the borrower had registered an F.I.R against the bank for cheating , breach of trust , forgery etc. Does this matter comes under the law of limitation act 1963? Is law of limitation is applicable to the notice sent under SARFAESI ACT by the bank in 2010?

I wonder what prompted you to relate this dispute with law of limitation which has no applicability herein.

Whats is the fate of FIR?

You could have escalated to MD,Chairman,Vigilance cell, RBI if the agreement was fake!

If documents are forged, lodge FIR.

I had already complained to the MD.,CHAIRMAN, VIGILANCE Cell of the Bank and also to the Fraud Monitoring cell of RBI, but nothing happened.Hence finally I moved to the Highcourt & filed the WRIT Petition in which the HighCourt ordered the Borivali Police station to lodge the FIR immediately.Currently the FIR is registered against the bank but no arrests has been made as according to the police all the culprits are absconding and the police are unable to locate them. The matter is currently pending before the Borivali Court.
