Wife asking for mutual divorce

respected Experts please help me.

my wife filed 498a case against me on 14 aug 2012 and now when the case has started her lawyer is asking for mutual divorce
but the problem is that he is asking me to first take divorce then he will withdraw the 498a case i.e:after 6months when the divorce completes please advice me whether i should go with mutual divorce or fight the case.

**my marriage is inter religious but it is not registered we have only video and photos for the marriage function performed

Accept the proposal of mutual divorce, that nay prove to be better. Also, get an agreement entered for withdrawal of 498a case, even if he accepts to do after 6 months.

Yes.. go for divorce with mutual consent by making an agreement containing the condition of withdrawing the 498a case.

If it is inter religion marriage and was not performed by changing of religion by one party or under special marriage act the marriage has technical lapse, discuss with your lawyer.
