parents bought property on the name of elder son. after demise of father elder son wittingly sells the property and doesn't pay mother her share in the property proceed and also doesn't pay her maintaiance to her. what should she do if she files suit wat should be her prayers

Irrespective of what had been mentioned above the Mother Could Seek the Remedy as per "Mainteinance and Welfare of Parents and Senior Citizens Act 2007 ". Please Discuss it with Local Good Advocate Or you could approach Free Legal Aid Forums in all the Courts.

Yes, she can claim maintenance under the aforesaid Act or under section 125 crpc.

If the property was in the name of elder brother, mother has no share in it / sale proceed of this property.
Mother can claim maintenance from son as per law.
