We have filed for mutual consent a month back . I want to try my best now to save the marriage . but my Husband has got admission to do his PG . if he is not willing to take me during his course of study . and leaves me ok n my maternal home later can he use the 1.5 years where he went to study as separation period and seek divorse

Merely on the grounds of separation for some justified reason shall not be a strong ground for divorce for him as he has left you for his personal reason.

It the court is satisfied regarding reason of separation, court may not order divorce on this ground.
Sudhir Kumar, Advocate (Expert) 04 April 2016
either you are imagining a trouble or you are hiding vital facts.
Geta (Querist) 07 April 2016
Not hiding facts sir. He used to hit me n give mental torture in anger I asked for divorse and he agreed now I want to save my marriage .hence asked the doubt that popped up

Do not agree for second motion of MCD, it would lapse after cooling period of 18 months from the date of first motion of MCD.
Discuss with your lawyer.
Sudhir Kumar, Advocate (Expert) 09 April 2016
Your blog is contradictory

one side you want to save marriage and on other side you have agreed to file MCD.

one side you are saying he used to hit you and on other side you want to continue with marriage.

one side your husband is voluntarily going away on education and other side you fear RCR case.

when husband is still a student no need to explain that marriage is immaturity and both husband and wife do not know that 2+2=4.
