(Querist) 13 August 2016 This query is : Resolved
Hello Seniors,

In a High Court Case, A plaintiff relies on Bank Accounts & Certificate issued from the bank. Is it COMPULSORY to have an Affidavit??

I mean to say that:-

I have already submitted Bank Transaction Statement & Term Deposit Statement & Certificates issued by bank as per the Banker's Books Evidence Act to the High Court, then is it Compulsory to submit an Affidavit also by bank??

Pls. Reply

Thanks

If court directs you to file affidavit then file it.

Not required, if court does not direct.

If court directs you to file affidavit then file it otherwise not required.

This is general procedure in all high courts to submit/place on record the documents supported with an affidavit to the effect that those have been obtained by deponent from such and such agency/authority and he has not made any changes therein. There is no harm to submit affidavit to that effect.
