Sir, My Grandfather (Has 8 children 5 M, 3 F)purchased a land in 1959 and original documents are misplaced. We, at present have only copy of those documents. My Late Uncle's wife sold the land illegally to a Visakhapatnam politician's concubine. Now, we have filed a partition suit in Visakha Court. Our Lawyer says Land original document is very much required to win the case. My query is what are other options for us to prove that land belongs to us only. Cann't we file a suit agaisnt Tehsildar, Sub Registrar, VRO etc who helped my Late Uncle's wife in illegal sale and registration??

The opinion of your lawyer is not lawful. You can lead secondary evidence means revenue record i.e. the certified copy of the sale-deed, the mutation entered thereupon and subsequent entry in 7/12 extracts. There is no requirement to produce original documents. You can lodge a police NC regarding the lost documents and may obtain its copy so as to make a ground to lead secondary evidence before the concerned court.

Your query has been suitably replied by learned experts. So far as taking action against government authorities is concerned you can not take any action against them unless you have proof of their involvement in so called illegal sale
