hi this is regarding divorce i need as soon as possible from my husband who is not mentally fit who has tried to commit suicide many times and always puts blame on me for my character i have a son of 5 months old now he started sending all dirty and third grade messages on my cell and everyone's cell in my family and even my friends and he says i had affairs before my marriage i had friens but i never had affair with anyone i am living with my parents and he had taken my cell long back from me and he doesnt used to allow me to talk to anyone from my family even if spoke to my jijaji he used to tell i have affair with him i am really fed up of him.now he says i have phone numner of a guy called as hussain and i will get all the recordings of the calls i made to him and i will prove ur affair,and his language is so cheap and vulgar in all his messages i just feel ashamed to tell those things.and he sends such messages to my friends also who are girls.please help me how to get rid of him and i am getting scared of the thing which he told about the recordings of the calls made by my cell.i have not seen such a third class man in my life please help and reply soon.

Pls file for divorce on the ground of cruelty and mental harrassment. Anyway, you have the messages he has sent to you and your friends and family. Save everything. Take printout if possible, so that you can prove it in court.

Also file a police complaint immediately about this harrassment and attempted suicide. Be careful to avoid, in case he tries to commit suicide and the blame actually comes on you.

Dear Zayaji,
I think the matter up to divorce has been arises due to the your cell message and in embarrassment you are trying to take divorce from your husband.So that you change your sim card and give only selected persons & friend.If your husband continue to harassment and defame on the ground of your sexual affairs with other then you have a right to claim a divorce against your husband in either LOK ADALAT OR IN FAMILY COURT.

I do agree with the common opinion of all experts. Additionaly file an application under section 12 of The Prevention of woman from Domestic Violence Act which is a summary procedure and you shall get many releifs from that court.

File a case under domestic violence Act before the magistrate where you reside and seek protection (and maintenance also, if you require it). It is the first step. Once after filing the case and notice is issued to your husband through protection officer (within 3 days of filing of the petition) you would be completely safe. Please do not forget to mention in this application very clearly, that he often, without basis, puts false adultery allegations against you and threatens to commit suicide. This would totally save you, if he really commits suicide by making a note incriminating you. If he is repeating any violent action (mental, physical and economic abuse), he would be put behind bars, under the provisions of the Act. If you are working, you would be protected even at your work place from his violent interference by his presence or by sending sms messages. You have to keep the record of sms messages and his threats of committing suicide etc. and false allegations about your character. This is the immediate remedy.
For permanent solution, you, in addition to above, have to file divorce case under the ground "cruelty" and keep the documentary and oral evidenced in tact, so that you can get the divorce.
There is no chance of reconciliation in your case, because he is mentally insane.
