Family Property

Dear Sir,
We own a property in Mumbai and it's registered under my father's name. My father has 4 daughters n 2 sons including me = Total 6 members. My father & Mother both have passed away many years ago and went to be with the lord. ( Catholic religion ) My father has not written any WILL before his demise. My 4 sisters along with me, want to sell our share in the property however my elder brother doesn't want to sell his share and wants to keep his share in the property.
Do we all need to register our names on the property 7/12 before we sell it or can five of us sell our share it without the registration.
How can we give our elder brother's share in the property seperately as he doesn't want to sell it and wants his portion of land?

First Apply for Legal Partition by Court with the help of your Advocates.Once Legal Partition is Done the Owners/Your selves Could decide with out any hinderance.

Who is Anonymous.The Person who had not Posted his details in his/its Profile only could be Anonymous.The querist/author who doesn't want to Post his name they just treat them selves as Anonymous and nothing wrong or illegal in it.The above Child Appearance Person had not given his/her/its detail in the Profile and he himself is an Anonymous.

I fully agree with Mr. Rajkumar. If someone does not disclose its name it does not mean that he does not deserve an answer from us. We should have belief that the queries are not posted just for fun. I belive that querrist having genuine problem when fail to find proper reply even from counsel at hand only then he send a post. We by subscribing to this site as an expert have taken a burden to advise all those to the best of our knowledge and experience who come seeking advice

Mr. Anonymous First of all get all the co-sharers register their name in revenue/municipal record. Then proceed for fileing partition suit. But remember it is a dwelling house and if court reaches at a conclusion that proper is not able of being partioned court may proceed to sale the property and devide sale proceeds among you
