WHETHER THE CIVIL COURT [JUNIOUR DIVISION] HAS JURISDICTION TO TRY THE SUIT UNDER THE HINDU ADOPTION AND MAINTINANCE ACT?

Nothing is mentioned in the Act itself but local High Court notifications/rules have vested powers to deal with all such matters to the courts. In Punjab & Haryana, such power vests only in Family Court wherein in UP, such power has been entrusted to Civil Judge (JD) so this provision is State to State different.

Unless an until the notifications and directions are issued by the state to the HIGH-COURT regarding to try the suits in these matters the powers are entrusted ,conferred and jurisdiction lies with them.It depends HIGHCOURT is burden with excessives cases to be diposed off it then delegates its powers and transfers the cases to Dist. Judges of Family Courts of that stateor states
