Gift deed

(Querist) 10 August 2017 This query is : Resolved 
Dear Sir,

We leave in a co-operative society. Its belongs to SKP community and as per bye laws only SKPs are allowed the live in the said society. My aunt has a flat and she is currently member of this housing society. My aunt's daughter got married to a person outside our community. Her mother has made a gift deed to transfer the said flat in her name. My aunt is alive. However the society is not willing to transfer the flat in her name as she got married to non SKP.

My question is, it is legal? If not, what action can be taken against the committee members?

check bye laws of said society as all depends on them.

Daughter may file civil suit if society refuse to transfer the property.

If society bye laws provide for such decision then recourse may be thru court of law..
