Land Name Changing

Hello, My grandfather has some properties in his name and he was shared the properties to his all three sons earlier and wrote in stamp paper the same which is not registered, but all four peoples are signed. The concern is my grandfather was expired few years back and all properties in his name only and we want to change to his sons name. We having his death, legal heir certificates along with property shared stamp paper. Please suggest , how we can change the name and where I can contact for this.

The property in hands of your grandfather was self acquired/ancestral?

In case of Hindu male; that dies without disposing his property in his life time by a valid/registered deed the 1st right is of : Mother(if alive as on date of death), Wife (if alive as on date of death), sons, daughters................for equal share.

So if mother of grandfather, and his wife died before death of grandfather...............his 3 sons have equal share.

If in the said unregistered stamp paper also equal share for 3 sons is given then there is dispute and disputable matter.

Is there any dispute amongst sons?

Otherwise if all sons agree to oral partition/MoU they can register the partition deed, on amicable terms.

If there is NO dispute: All sons may approach local O/o Authority, concerned Official say Patwaari and submit the docs as mentioned by you to record inheritance.........and obtain update mutation records showing share by inheritance.........

This should suffice.
