There are chances that Job on compassionate grounds to the Legal heirs of the Employees who gives VRS - volunteer retirement from service based on Medical Grounds. But it can not be treated as Legal Right and only on Compassionate grounds.
Guest (Expert) 05 June 2018
Job on Compassionate grounds would be only based on considerstion

Discuss with Higher Officials in a polite and pleading manner before you could take a decision please.

Wasting precious time in false hopes given by some quacks is not wise. False hopes cannot sustain, as against Government rules.

Download the Compassionate/Compensate Employment rules of establishment and attach in Forum section..
Also mention about the debilitating disease due to which your father is unable to attend office.
Kumar Doab (Expert) 05 June 2018
Your father must be aware of the rules and even seasoned employee's/trade union leaders of the establishment can help you to get a copy as well to understand the rules and even make you aware of precedence..
Ms.Usha Kapoor (Expert) 06 June 2018
Refer the rules of TNEB govt sector rules and you will know whether you will get Dad's job on compassionate grounds or not on account OF HIS ILLNESS DUE TO A DEBILITATING DISEASE which is listed for compassionate appointment or not.If your father takes VRS on account of illness there are rules for appointment of his legal heirs in Govt service.on compassionate grounds. But they should be considered for appointment in Government service but not as of right you can't demand to be appointed on compassionate grounds.
Sudhir Kumar, Advocate (Expert) 06 June 2018
First of all no compassionate job is offered in case of voluntary retirement by employee due to any ground.

This employment is considered only in case of (i) death and (ii) disablement.

Then he quota for such job is very limited and selection is made on the basis of level poverty faced by deceased employees' families. This process has o relevance to the qualification of the candidate.

Therefore what Mr Dhingra has told has a practical relevance.

Instead of giving any false hopes to the author of the query, Ms. Usha Kapoor may like to provide the reference of some specific rules of the TN Government or the TNEB, if that provided job to the sons of an employee after his voluntary retirement..

If rules provide employment to sons and daughters of an employee on voluntary retirement, every employee of Government department and PSU would prefer to take voluntary retirement to manage jobs for their legal heirs, generation after generation.

Very vague posts by Mr. Kumar Doab!

If Mr. Kumar Doab knows any such rule to get employment on account of sickness or voluntary retirement of the father of the querist, he should have advised him accordingly, If he wanted the author of the query maker to download any such rules, if existing on this earth, he should have provided him the link before asking him to download and attach in the forum, instead of misleading him just to waste his time for days together in search of any such non-existing rules. Further, if he can download the rules, what for he should attach in the forum, when he could know for himself, whether he would be eligible for any employment or not.

It is unlikely that a such scheme would be in vogue. Anyhow, you may verify with the TNEB.

Compassionate Jobs om Medical retirement is Valid. The order was Pronounced by Supreme court Bench of Honorable Justice R.V. Ravindran and L.S. Panta in August 2008 quashing the Orders of Andhra Pradesh High Court which said such appointments are illegal.
Sudhir Kumar, Advocate (Expert) 07 June 2018
Normally such scheme exists in govt deptt.

however if he was able to download and understand he was not here.

There is no point of guiding him to download the rules which do not apply to his case. His father is alive and not discharged from service on medical ground .

There is nothing like taking VR on medical ground. An employee with 20 years of qualifying service can do so without assigning any reason. One has to understand the different between:-

taking VR on any ground

deptt getting the employee examined by medical board and discharging him.

when a Person is permanently incapacitated due to serious illness or accident and when he is not able to render his services the family would be thrown in to financial hardship because not only the income being stopped but also there would be considerable expenses for medicine and medical treatment.

August 2008 Supreme Court Honorable Bench of Justice R.V.Ravindran and L.S.Panta had up held the constitutional validity of employment on compassionate grounds of spouse and children of government servants.who seek retirement on medical grounds.
Guest (Expert) 07 June 2018
Such appointments will not violate Article 14---equality before law and Article 16 ---equality of opportunity in matter of public employment. the Supreme Court said.
Guest (Expert) 07 June 2018
Supreme Court Orders quashed the orders of Andhra Pradesh High Court Orders which held such appointments are illegal.
Guest (Expert) 07 June 2018
Dear Querist In your case first make a humble polite pleasant pleading to the concerned Higher Officials. Depending on the result discuss with a local advocate referring the citations mentioned above please.

Some fake experts are merely trying to grab dominance over the LCI portal in a vain bid to stress on their points by making multiple posts just to create confusions only, when they do not know the rules and regulations about the compassionate appointments.

Not going to office due to illness is not a valid ground for appointment of his son on compassionate grounds. However for experiment sake, you can feel free to apply those formulas given by some quacks, if you can get even 1% success.

one sentence one post.
Sudhir Kumar, Advocate (Expert) 07 June 2018
Any way compassionate job cannot be considered as long as his father is alive and in service.
