DOCUMENTS WITH W.S.

Sir,
I received the copy of W.S. After a long period I came to know that defendant along with his W.S, filed lots of document which were not provided to me. I filed application to court asking the copies of these document, defendant objected. Next date is fixed for hearing on this point. Please help me.

defendant can not object to it, he is duty bound to provide u with all the documents he attached with the written statement.

I differ.O.VIII (1-A) says 'at the same time, deliver the document and a copy thereof, tobe filed withthe written statement'...does not mean that the deft.is bound to give copies of documents to the pltff.Similar is the porovision under order 7,rule 14 for pltff. As per O.IV rule l,the plaint is tobe filed in duplicate and a duplicate copy of plaint is needed for records.Similarly,the deft.has to file the WS and copies of documets in duplicate for court records.

instead of going into more litigation file application fr certify copy and obtain them always simplified u r litigation.
