medical negligience

i am been blessed with a daughter. but a big blunder happened in the hospital, because of the communication error between the doctor and the nurse a wrong injection was given to the infant.

the infant went through the tough time so do we. their was 4 exchange blood transfusions done and suffered from major jaundice and the bilirubin level reached 26.

she looks ok but doctors themselves are not sure about the future.

please advise what should be the course of action

As per latest consumer case law on medical negligence, such negligence cases are to be referred to the experts panel. It is presumed that the hospital is a Pvt one, hence, submit an application to your state's Medical Council, Health Department as well as seek the concerned state govt medical experts opinion in writing. If there is no help coming forward from the state authorities, seek remedy through 'Writ' petition at High Court. Another alternate is to file a consumer complaint with a petition requesting their direction to refer your complaint to the concerned Govt machinery for 'expert opinion'.
