Better to get full info from local sub registrar, it may varies from diffrent states.

It will be illegal. firstly, the building permission for such terrace covering cannot be obtained; secondly, the other owners of the flats can object; thirdly, all the flat-owners are entitled to undivided share of the land, in this case, the future owner of the terrace cannot claim any such share.
