Replacing Father

Querist : Anonymous (Querist) 17 June 2010 This query is : Resolved
Sir,
My father is about 75 yrs old and due to his physical constraint he is unable to attend the court for any purposes. I am living with him and do all the work on behalf of him. We r three brothers. Two lives outside. Can I replace my father for court work like putting signature and deposing on behalf of him in the court? My father as well as other brothers too r having no objection. For this what I will have to do? Authorization letter or power of attorney is needed?
Thanking all of u.

Dear Anonymous,

You need not to do anything but to coordinate with your father's counsel. In so far signatures on the papers is concerned the same can be brought to house instead of your father going to the court. Apart from this for the purposes of recording of evidence and cross examination as well the court commissioner can be appointed.
However still you want to participate in the proceedings your father has to execute Power of Attorney in this regard performa whereof can be available on this site as well otherwise you may login to www.chamberpractice.com
Best Regards

Daksh

Sir,
Thanks for prompt reply.
Does the POA need to be registered. Since my father remains mostly out of the town, to my brothers house, in that case obtaining signature becomes difficult.
Special many many thanks for the website mentioned.

Notarisation of POA will do. Registration is not required.
